The Sunnyfide SwellShell is a unique product because this type of head protection for surfing isn’t really a definable thing yet. The closest comparison to a protective shell inside of a hat is what is known as a bump cap, which is intended for minor impacts with stationary objects.
Certified surf helmets do exist and are designed and tested specifically for surfing and provide validated protection for surf conditions and are more appropriate if you are concerned about a head injury while surfing.
The SwellShell has undergone comprehensive independent laboratory testing (performed by ACT Labs, Long Beach, CA https://act-lab.com/accreditation-tests-2/) using EN 812:2012 methodology (industrial bump cap standard for stationary object impacts). Test results showed no penetration at apex under standard test and force transmission levels consistent with EN 812:2012 requirements for industrial bump caps (≥15Kn). THIS PRODUCT HAS NOT BEEN OFFICIALLY CERTIFIED TO EN 812:2012 OR ANY OTHER STANDARD BY ANY CERTIFICATION BODIES OR REGULATORY AUTHORITIES. THEREFORE THIS TESTING DOES NOT CONSTITUTE OFFICIAL CERTIFICATION. IMPORTANT: Passing industrial bump cap testing does NOT indicate this product is safe, adequate, or appropriate for surfing. These are completely different use cases with different hazards

SURF-SPECIFIC IMPACTS NOT TESTED: This product has NOT been tested for protection against: surfboard strikes (nose, rail, fin contact); reef, rock, or ocean floor impacts; shallow water impacts; wave force and turbulent water impacts; collision with other surfers or equipment.
FEDERAL TRADE COMMISSION DISCLOSURE: This testing does NOT constitute substantiation for any safety claims for surf use. We make NO CLAIMS that this product:
- Provides adequate protection for surfing
- Reduces injury risk while surfing
- Is safe or appropriate for surf use
- Offers validated protection for any surf-specific hazard
ASSUMPTION OF RISK: By purchasing and using this product, you expressly acknowledge, understand, and agree that:
1. Bump caps are designed only for protection against minor impacts with stationary objects and not specifically for surfing or water sports. This is NOT an industrial safety helmet.
2. This product has been independently tested using EN 812:2012 methodology but is NOT officially certified to EN 812:2012 or any other standard by a notified body or certification organization.
3. No bump cap can prevent all head injuries in every scenario, and that real-world conditions differ from controlled laboratory testing.
4.You accept full responsibility for determining whether this product is appropriate for your specific intended use and work environment.
5. Tthis product does NOT satisfy requirement for certified safety helmets where such helmets are required by OSHA, workplace policy, or other regulations.
LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW:
1. The manufacturer makes NO WARRANTIES OR GUARANTEES regarding absolute protection against all potential risks.
2. The manufacturer's total liability shall not exceed the purchase price of the product.
3. The manufacturer shall NOT be liable for consequential, incidental, special, or indirect damages including but not limited to lost wages, medical expenses, or other injury-related costs.
4. Some jurisdictions do not allow limitation of liability for personal injury, so these limitations may not apply to you.
5. This limitation of liability does not affect any statutory rights that cannot be waived under applicable law.
