These Terms & Conditions (“Terms”) govern your access to and use of sunnyfide.com (the “Site”) and the purchase or use of any products sold by Sunnyfide (“we,” “us,” or “our”).

By accessing this Site or purchasing or using our products, you agree to be bound by these Terms.

1. PRODUCTS & USE DISCLAIMER

Sunnyfide products are not safety helmets and are not certified protective equipment, unless explicitly stated otherwise.

Our products provide limited protection only and are not designed, tested, or approved for surfing or water sports. Any testing disclosed does not constitute certification or validation for surf use.

You are solely responsible for determining whether a product is appropriate for your intended use.

2. SAFETY INFORMATION

All safety warnings, labels, inserts, and information published at sunnyfide.com/safety are incorporated into these Terms by reference. Failure to read or follow provided safety information may increase the risk of injury.

3. NO WARRANTIES

To the maximum extent permitted by law:

• All products are provided “AS IS” and “AS AVAILABLE”
• We make no warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement
• No oral or written statements create any warranty

This disclaimer does not limit any rights you may have under applicable consumer protection laws, including California law.

Some jurisdictions do not allow limitations on implied warranties, so certain limitations may not apply to you.

4. ASSUMPTION OF RISK

You acknowledge and agree that:

• Use of our products involves inherent risks
• No product can prevent all injuries
• You voluntarily assume all risks associated with the use or misuse of the product

Nothing in this section limits liability that cannot be excluded under applicable law.

5. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

• Sunnyfide shall not be liable for indirect, incidental, consequential, special, or punitive damages
• Sunnyfide’s total liability shall not exceed the amount paid for the product giving rise to the claim

Some jurisdictions, including California, do not allow limitations on liability for personal injury in certain circumstances. This limitation applies only to the extent permitted by law.

6. INDEMNIFICATION

You agree to indemnify and hold harmless Sunnyfide, its owners, officers, employees, and agents from any claims, damages, losses, or expenses arising from:

• misuse of the product
• violation of these Terms
• violation of applicable laws or regulations

7. RETURNS & REFUNDS

Returns accepted within 30 days of delivery for products in original, unused condition with original packaging. We reserve the right to refuse returns that do not comply with that policy.

Customer pays return shipping; original shipping is non-refundable. Contact howdy@sunnyfide.com to initiate a return.

8. INTELLECTUAL PROPERTY

All content on the Site, including trademarks, logos, text, graphics, and images, is the property of Sunnyfide or its licensors and may not be used without prior written permission.

9. USER CONTENT (IF APPLICABLE)

If you submit reviews, comments, or other content, you grant Sunnyfide a non-exclusive, royalty-free, perpetual license to use, reproduce, and display such content.

You represent that your content does not infringe the rights of others.

10. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.

11. DISPUTE RESOLUTION (OPTIONAL)

Any dispute arising from these Terms or the use of our products may be resolved through binding arbitration on an individual basis, except where prohibited by law.

Nothing in this section limits your right to pursue claims in small claims court or to seek public injunctive relief where such rights cannot be waived under California law.
